Calhoun’s lawyer files for new trial

Clinton Calhoun may stand trial again for charges of attempted rape and battery after his new defense attorney announced on Thursday her intent to file a motion for a new trial.

A jury of his peers found Calhoun, 31, guilty of the charges in January, for which he was scheduled to be sentenced on Feb. 27. However, the case was further postponed after an unexplained two-hour closed door court session between visiting Judge Edward M. Lacy Jr. and the attorneys involved in the case.

During the 9:30 a.m. proceedings, it came to light that Calhoun dismissed his previous defense attorney, Eric Hamilton, and is pursuing a motion for a new trial with attorney Donna Tartar.

"Mr. Calhoun is still thinking about this decision, so we are not committing to it just yet," Tartar said in court. "If he changes his mind, we will continue on trying to reach a possible resolution instead."

The defense is required to decide on and file the motion by May 1, with the prosecution asked to respond to it by May 23.

If the motion is filed, both parties will meet on June 4 for what Judge Lacy described as a "lengthy" court session where witnesses will be called to determine if the motion should be accepted.

The case is being prosecuted by the State Attorney General's Office, as Calhoun is the son of Kings County District Attorney Ron Calhoun. All county prosecutors and judges excused themselves from the case during its early stages.

Calhoun was originally arrested on the charges in March of last year.

" If they found him guilty, than "WHY" is he getting special treatment? You have a girl in a parking lot, and a young man that ran to her and saved her. Police report states that he was caught with his pants down "literally"! Why should he have a retrial? I am damn sick of paying tax dollars for this kind of preferencial treatment just because the defendant is the son of a big wig! Were is the fairness here? The guy needs to be placed in a court ordered rehab to come clean obviously, before the court sets a criminal free and he does this to another "INNOCENT" female!!! Dang were is the justice here? "

" If this was anyone else, he would be in prison serving his sentence by now. Deny, Deny, Deny delay, delay, delay it's what makes our court systems go around. You want a delay fire your attorney, you want another delay tell them you need more time to make up your mind how you wish to proceed. Get this person the help he needs and then let him serve out his punishment for what he did. He obviously has a problem society hasn't been able to fix. The continued plea bargains for probation haven't done the trick. It's time to hospitalize him give him treatment and the help he so desperately needs. He has some strange habits and behavior those need to be addressed. Don't lock him up and throw away the key for five years treat the ailments several of which seem to be psychological. Do it now before someone else is hurt. "

" Alan, the how and the why behind the motion were apparently discussed during the closed door session they had last time. During Thursday's session, nothing else was said aside from what I mentioned in my article. I've attempted numerous times to pull the court case file and get some answers from there, but since the matter is being prosecuted by the State Attorney General's Office, the file has been missing in action for a while now, presumably because they have it in Sacramento and it isn't being kept locally. If I get a chance to talk to Mrs. Tartar, I'll be sure to ask her what is going on here and write an update about it. "

" Addicition is a disease which tears families apart. It is emotiionally draining. Until family members get educated about what they are dealing with and how to navigate through the challenges associated with addiction emotions take over. Getting an addict to admit he or she needs help is hard, especially when they are young. Next add in a drug like methamphetamine (which most people in this community are very ignorant about) and the problem is compounded ten times. Jails and prisons are filled with addicts who repeat crimes when released because the root problem has not been dealt with by the system or the inmate. I too want to live in a safe commulnity, but people with a history like Mr. Calhoun's need to be directed to incarceration that includes rehabilitation for the disease that they carry. I know many people in this community who once received very harsh judgement for their addiction, however, they have been in recovery for many years now and live very productive lives. They praise God, rehabilitation resources, and the support of people who loved and believed in them. The worth of a soul is great. "

" The cost of rehabilitation is far less that incarceration in a number of ways. At least there is a chance of having the person become a productive member of society. If we don't wake up and think differently we will be spending the rest of our lives financing more jails and prisons. There is only so much the employed taxpaying public can bear. "
